Library Copyright Usage Management Regulations

 

Chapter 1 General Provisions

 

Article 1 These Regulations are formulated in accordance with the "Copyright Law of the People's Republic of China", "Regulations on the Protection of Information Network Transmission Rights" and other relevant laws and regulations, combined with the actual situation of the library, for the purpose of safeguarding the rights and interests of intellectual property, standardizing the use of library literature resources, and ensuring the legal utilization and sustainable service of the collection resources.

 

Article 2 These Regulations apply to all units and individuals (hereinafter collectively referred to as "users") who use the library's printed documents, electronic resources, and related services, including teachers, students, university staff, off-campus readers with valid certificates, and other authorized visitors.

 

Article 3 As a literature resource service institution, the library is committed to guiding users to establish an awareness of intellectual property protection, practice the principle of "fair use", and create a good environment of respecting innovation and standardizing the use of rights.

 

Chapter 2 Management of Printed Document Copying

 

Article 4 When using the library's copying equipment or services, users must strictly abide by the provisions on "fair use" in the Copyright Law and are strictly prohibited from engaging in copying behaviors that infringe copyright.

 

Article 5 The following quantitative standards shall be followed when copying printed documents in the collection:

· The copying amount of a single book shall not exceed one-fifth of the total content of the book, or shall be limited to copying one complete chapter thereof;

· For a single kind of serial publications such as periodicals and newspapers, the copying amount shall not exceed one complete article (if the length of the article exceeds one-fifth of the total length of the publication, the copying amount shall be controlled according to the proportion of one-fifth of the total length).

· When multiple people collaborate on research and need to copy the same document, the amount of copying for each person shall be calculated separately, and they shall not combine and accumulate to evade the quota.

Article 6 Library staff have the right to dissuade and explain the reasons when discovering copying requests beyond the scope of fair use; for acts of maliciously evading the regulations, they may suspend the provision of copying services.

 

Chapter 3 Copyright Protection of Electronic Resources

 

Article 7 To ensure the legal use and service stability of electronic resources, users must abide by the license agreements of resource providers and these Regulations when accessing and using databases, electronic periodicals, electronic books, and other resources purchased by the library.

 

Article 8 The following acts of illegal use of electronic resources are strictly prohibited:

  1. Using illegal downloading tools such as Thunder and eMule, or batch downloading electronic resources through technical means such as scripts and crawler programs;
  2. Conducting continuous, concentrated, and systematic downloading, browsing, and searching operations within a short period of time (the specific threshold shall be subject to the early warning standard of the resource provider);
  3. Forwarding and sharing the obtained electronic documents to off-campus personnel, or lending and transferring personal network accounts to off-campus personnel for them to use electronic resources;
  4. Using the content of electronic resources for commercial publishing, information services, and other business activities for profit-making purposes;
  5. Setting up proxy servers without the written permission of the library for others to access electronic resources is prohibited. If an on-campus unit needs to set up a proxy due to special work requirements, it must submit an application to the library in advance. After approval, access to the scope must be strictly limited. It is strictly prohibited for off-campus personnel to access the system through a proxy.

Article 9 Users shall properly maintain their personal network accounts, passwords, and used equipment, and be responsible for the use behaviors associated with their accounts. If the illegal use of electronic resources is caused by improper management, such as account theft and equipment intrusion, the account holder shall bear the corresponding responsibilities.

 

Chapter 4 Handling of Violations

 

Article 10 After discovering violations through resource monitoring systems, user reports, and other channels, the library will promptly issue written or electronic notices to the violators, clarifying the violation facts and handling requirements.

 

Article 11 Violators shall go to the designated department of the library to accept the investigation and submit a written explanation within three working days after receiving the notice. Those who fail to cooperate with the investigation within the specified time limit shall be subject to more severe handling, depending on the circumstances.

 

Article 12 According to the seriousness of the violation circumstances, the library will take the following handling measures:

· For minor circumstances, an oral warning shall be given, and a time limit for rectification shall be ordered.

· For severe circumstances, the access rights to electronic resources and relevant library services shall be suspended for 3-6 months.

· For severe circumstances (such as massive downloading for profit, repeated violations, etc.), it shall be reported to the relevant university departments for disciplinary sanctions and notified to the entire university.

· Those who cause intellectual property disputes or legal liabilities due to violations shall bear all the consequences by themselves.

 

Chapter 5 Supplementary Provisions

 

Article 23 Matters not covered herein shall be implemented in accordance with the "Copyright Law of the People's Republic of China" and other relevant laws and regulations.

 

Article 24: These Regulations shall be interpreted and revised by the library.

 

Article 25: These Regulations shall take effect on the date of issuance. If the original relevant regulations are inconsistent with these Regulations, these Regulations shall prevail.
